My Insurance Case Wins Million Dollar Judgment

We are pleased to announce that we have won a significant judgment on behalf of a client located in Odessa, Texas. The case was pending in the United States District Court, Western District of Texas. It originated as an interpleader action initiated by a life insurance company. The primary dispute was whether a life insurance company was obligated to pay our client a one-million-dollar death benefit or to the estate of her ex-husband. Although our client owned the policy, there were complex issues related to the interpretation of her divorce decree as well as how Texas law views ownership of riders to insurance policies. A secondary issue was whether our client’s rights under the policy were revoked when she divorced.

Following a significant amount of research, briefing, arguments, and discovery, the Court agreed with our positions and granted our motion for summary judgment, awarding the death benefit to our client. The Court ruled that a rider to a policy is an addendum coverage and is viewed as part of the policy it is attached to. This was an important distinction in the case because the divorce decree awarded to the ex-husband policies that insured his life. Since the rider was considered part of our client’s policy, the divorce decree did not alter her ownership.
