Getting Results for Mississippi Policyholders: Half-Million Dollar Settlement

In one recent case involving Mississippi policyholders, Jeremiah Johns and Pete Stokes obtained a significant settlement in a residential fire claim. The insurance company had dragged out its investigation of the claim for several months with no resolution in site. The insureds ultimately reached out to Jeremiah Johns and Pete Stokes after the insurer requested an examination under oath. In preparation for the examination, we learned that the carrier intended to deny the claim asserting that the insureds caused the fire that resulted in a total loss. In response, Jeremiah and Pete assisted the clients in gathering the documents, expert reports, and information needed to show that the fire was not the cause of arson. Ultimately, the carrier accepted coverage and settled the claim allowing the insureds to move on with their lives.

Major fire losses are often questioned by insurance carriers due to the large potential payout to the insured. The carrier may investigate the claim with an eye to creating a rationale for denying coverage. In these situations, the insurer may retain a cause and origin expert to issue an opinion that the fire was caused by arson. It is also not uncommon for the carrier to retain an attorney to investigate the claim and take the insureds’ examination under oath. The reality is the carrier has the duty to present clear evidence supporting a claim denial. We assist insureds in these difficult situations by presenting evidence supporting their claim and contesting the reasons for denial.
